RMail just released an RMail app integrated into Box (formerly Box.net) that extends document delivery options with a familiar email user experience. Box’s RMail application allows users to send files attached to Registered Email™ messages from within their Box account, for the most legally robust record of who sent what documents to whom and when by email, with time-stamped proof of document content delivered to the recipient’s inbox; as well as HIPAA compliant email encryption and electronic signing options providing auditable proof of recipient consent or signature on documents sent by RMail from Box online file storage. RMail is offering these services from within the Box interface free for the first ten documents sent per month, with file sizes up to 200MB per transmission.
Consider in Zubulake v. UBS Warburg, a case focused on the duties of in-house and outside counsel related to litigation holds and document retention policies. Although UBS Warburg claimed to have issued and reissued litigation holds, the court concluded that “a party cannot reasonably be trusted to receive a litigation hold instruction once and to fully comply with it without the active supervision of counsel.” The court suggested instructions for in-house and outside counsel to follow as a means of demonstrating their “continuous efforts to satisfy the duty,” which includes: (1) issuing a litigation hold at the outset of litigation or whenever it is reasonably anticipated, including reissuing them periodically; (2) communicating directly and periodically with key players regarding preservation duty; and (3) instructing all employees to produce electronic copies of their relevant active files and to ensure that all backup media is identified and stored in a safe place.

Three weeks after the publication of my open memo to Facebook CEO Mark Zuckerberg – first published by Business Insider on June 8, 2011 – plaintiff lawyers from law firms DLA Piper LLP and Lippes Mathias Wexler Friedman LLP dropped out of their lawsuit against Facebook, despite the awaiting percentage of a potential $25 billion bounty. This memo, with the subject, “Grounds for Early Dismissal of Ceglia’s Claims — Paul Ceglia’s $25 Billion Mistake,” was written by me to provide assistance to Zuckerberg in response to a recent lawsuit filed by Paul Ceglia where he claims to have emails from 2004 which show Mark Zuckerberg allotted him 50% of Facebook equity.
